International Registry Procedures

 

     With the implementation of the International Registry in March, 2006, the acquisition of certain aircraft became increasingly time consuming, however not complicated.

     The International Registry is applicable to aircraft capable of being configured with 8 seats or more, helicopters of 5 seats or more, and engines rated 550 shp and above. The International Registry has nothing to do with obtaining a Certificate of Registration to accommodate legal flights within or outside of the United States. Rather, it is a central registry located in Ireland whereby citizens of member countries, including the United States, can file an electronic notice of an interest in a specific piece of collateral. Note that the law governing interests filed with the International Registry supersedes interests filed only with FAA. Therefore, although not required, it is strongly recommended that you file your interest with the Federal Aviation Administration AND the International Registry.

      In order to file an interest in a specific piece of collateral, each party must first be a registered entity user of the International Registry. To become a registered entity user, enter the website https://www.internationalregistry.aero, click on “User Area”, and follow the prompts to “Become an Administrator User”. Once approved by the International Registry, you will receive a digital certificate to be downloaded onto the computer on which application was made. All further research or registrations must be done on the same computer where the digital certificate is located. You should write down the password used to set up your account. It is surprising at the number of people who forget the selected password!

     An interest registered by virtue of a Bill of Sale will require both the seller and purchaser to be registered entity users. An interest registered by virtue of a Security Agreement will require both the debtor and secured party to be registered entity users.

     Prior to closing, your escrow agent will ask for each party’s consent to file an interest with the International Registry. Each entity will receive an e-mail, through the International Registry, explaining that they must enter the International Registry website in order to consent. The process to consent is brief and fairly simple. Again, this process must be completed on the same computer where the digital certificate is located.

     At the time of closing, documents are filed with the FAA, along with form 8050-135 which allows FAA to issue an IRN code. This code is used by the escrow agent to file the international interests with the International Registry.
